Is it permissible for a judge to annul a marriage in Islam without any legitimate Shar'i excuse?

1 min readAlso available in العربية

It is not permissible for a judge to annul a marriage without a legitimate reason, nor to rule in contradiction to a text, consensus, analogy, or a general principle. If he does so, his ruling is to be overturned. However, in matters of permissible disagreement, he may rule according to what he deems fit, and neither another judge nor he himself may overturn it, nor is it permissible for a mufti to issue a fatwa contradicting it.
