If a man divorces his wife due to her infidelity, she is entitled to all the rights of a divorced woman, such as deferred dower, ' (waiting period) maintenance, and housing. There is no difference in this regard between her and a wife who was not unfaithful. This applies whether the infidelity was through adultery or otherwise, as deferred dower is not forfeited by adultery. However, if the infidelity was an act of moral transgression like adultery, the wife’s right to custody of the children is forfeited until she repents.
