The question

Is a wife considered disobedient (nashiz) if she refuses to give up her job, which has led to a dereliction of the husband's rights and the children's care, despite a prior agreement that the job would not affect these rights, and is she entitled to a "mut'ah" (consolatory gift) and "iddah" (waiting period) maintenance if divorced?

The answer

The disloyalty and disobedience of a wife nullify her right to maintenance. The nullification of maintenance continues during the (waiting period) unless she is pregnant. If she seeks divorce without a valid reason, there is no harm in refusing her divorce until some of her rights are forfeited. A wife's stipulation in the marriage contract to work outside the home is a binding condition, but it does not permit her to go out if it harms the rights of her husband and her home.
