The question

Does divorce occur when there is doubt about it due to the wife's frequent request for it during jokes and problems, and by the husband saying to his wife: "I am stuck with you, I don't want you, and I will consult with my family about separating from you"? And does the wife remain married to her husband if the husband assumes that his divorce has occurred and then takes her back, then discovers that the divorce did not occur? And does divorce occur through thinking or imagining separation?

The answer

The inquirer's situation is easier than this anxiety and tension, because he is under the influence of whisperings (waswasah) concerning divorce. The divorce of one who has reached this state of waswasah does not take effect. The certainty of the marital bond remains and is not removed by doubt. The wife's joking request for divorce is inappropriate, and she must offer sincere repentance. The inquirer is advised to hasten the completion of the marriage and consummate it with his wife. He should strive to rid himself of these whisperings by ignoring them, frequently remembering Allah, seeking refuge in Him, and performing upon himself.
