If a husband writes a letter to his wife divorcing her by triple , and he intends the divorce, then the three divorces have occurred, and she is irrevocably divorced from him (baynunah kubra). She does not become lawful for him again unless she marries another man (a marriage of desire), and he divorces her after consummating the marriage, or he dies, and her ' (waiting period) expires. The determining factor is what the husband wrote or uttered, not what was written in the marriage contract. If the husband claims that he did not intend divorce by writing, then there is a difference of opinion regarding the occurrence of divorce. It is advisable to present the matter to a court or to reliable scholars.
