Does divorce occur if the husband swears that his wife is divorced if she leaves the house and anyone smells a perfumed scent from her or if she applies any perfume, and then the wife disobeys and applies deodorant (spray) knowing that she applies perfume to the body and not to clothes?

The majority of scholars hold the view that swearing by divorce results in divorce if the sworn-upon condition occurs, and this is the prevailing fatwa (definition). This differs from the view of Ibn Taymiyyah, who considers it to be like an oath, requiring an expiation (kaffarah (definition)). The determination of what was sworn upon depends on the intention of the swearer. Therefore, if your husband intended to prevent you from applying anything that contains a perfumed scent when you leave, and the deodorant you applied was scented, then a divorce has occurred. If this was the first or second divorce, he may take you back as long as you are within your iddah (definition) (waiting period). If it was the third divorce, you are not permissible for him unless you marry another man in a marriage of genuine desire, and then he divorces you or dies, and your iddah from him ends. We also caution that it is forbidden for a woman to perfume herself when she goes out.
