A marriage contract with a fifth wife is invalid and void by consensus, based on the Almighty’s saying: "Marry such women as seem good to you, two, or three, or four." If he consummates the marriage while knowing the religious ruling, he has disobeyed Allah and must repent. This marriage does not require divorce or annulment by scholarly consensus. Nevertheless, the effects of this marriage—regarding lineage and inheritance—are attributed to it, because most who engage in it do so out of ignorance or misconception. If he believed it permissible due to ignorance or misconception, the child is attributed to him, because misconception averts legal penalties and necessitates the attribution of lineage, in order to preserve lineages.
