How can the dowry and rights be obtained when seeking divorce from a husband who possesses the mentioned characteristics?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
If the husband severely beats his wife, or beats her without justification, or does not provide her with the obligatory maintenance, then the wife may refer him to the ruler (judge) to compel him to treat her kindly (cohabit in a good manner) or to divorce her while fulfilling her rights. However, if he provides for her and does not beat her except with the beating permitted by شرع (Islamic law), then she has no right to divorce. If she is harmed by his sexual frigidity, she may seek a khul’ (divorce at the instance of the wife) in exchange for waiving some of her rights.
