It is permissible for a woman to request a divorce due to her husband's persistence in grave sins. If he refuses to divorce her, she may resort to the Shar'i judge or the Islamic authority. If a secular court compels the husband to divorce and he pronounces it or writes it with the intention of divorce, then the divorce is valid. However, if he does not pronounce or write it with the intention of divorce, and the court rules for divorce, the divorce decreed by a non-Muslim judge is not valid, as Islam is not a condition for a judge who rules between Muslims. One may resort to secular courts to claim rights, but a civil divorce does not terminate the marriage Islamically unless it is affirmed by an Islamic center. If the woman is divorced with a first or second pronouncement and her ' (waiting period) ends, the husband may take her back with a new contract and a new mahr (dowry). However, if she is divorced with three pronouncements, she is not lawful for him until she marries another husband.
