Is 'iddah obligatory for a woman who was irrevocably divorced without having been touched for two years prior to the divorce, and is it permissible for her to marry customarily after two months from the divorce in the presence of her guardian?
Source: FtawySummary from Ftawy's records · added here Sep 2, 2026
A divorced woman must observe her ' (waiting period) from her husband's divorce, and his abandonment of her is not considered. The 'iddah of a divorced woman ends with childbirth for a pregnant woman, or with three menstrual cycles for a non-pregnant woman, or with three months for a woman who does not menstruate. Marriage before the expiry of the 'iddah is invalid. If consummation occurs, separation is obligatory, and the woman completes her 'iddah from the first husband, then observes 'iddah from the second husband. Documenting and registering the marriage contract is necessary to avoid corruption and the loss of rights.
