The question

Is it obligatory for a wife to remain with her husband despite his ill-treatment, abandonment, betrayal, foul language, financial neglect, and uttering of divorce over trivial matters, or should she seek separation from him out of fear for her children being scattered, especially since she fears for her psychologically sensitive daughter?

The answer

If the husband disbelieves and apostatizes from the religion, then separation from him becomes obligatory because the marriage contract is annulled by apostasy. Otherwise, the obligation is to advise him with wisdom and good admonition. If the wife is harmed by his harshness and ill-treatment, she has the right to seek divorce; otherwise, she should be patient.

Swearing by divorce falls under the ruling of conditional divorce. It is forbidden for the husband to abandon his wife unless there is a legitimate reason, just as it is forbidden for him to engage in an emotional relationship with a strange woman. He is obligated to spend on his wife and children.
