The answer

It is permissible for the ignorant layperson to adopt the opinion of Imam Shafi'i by way of (emulation), not out of desire or seeking out dispensations. However, if one of the parties to the contract does not agree with the Shafi'i , then it is necessary to refer the matter to the court for the judge to rule on it, because the judge's ruling resolves disagreements in matters of marriage and divorce.
