The second form is valid in terms of its conditions and pillars, which is with the guardian's consent but without public declaration or documentation. However, it violates the شرعي (Shari'i) command regarding the necessity of declaration, and it may lead to the loss of rights and difficulty in proving lineage. The preponderant opinion is that declaration is a condition for the validity of the marriage contract, in order to distinguish between what is lawful and what is forbidden.
