Is it permissible to seek a khulʿ from a husband who does not believe in the Prophet Muhammad (peace be upon him), often commits acts of disbelief, demands his wife remove her hijab and abandon her religion, beats her, and does not provide for her expenses?

If the husband does not believe in the Prophet Muhammad, peace be upon him, he must be taught that belief in him is essential. If he repents and believes in the Prophet and adheres to his Sunnah (definition), then praise be to Allah. Otherwise, he is an infidel, and it is impermissible to remain with him. However, if he did not believe in him at all at the time of the marriage contract, then there is no marriage between them. If he apostatizes, some jurists hold that his repentance is not outwardly accepted, while others believe he should be punished with beating and imprisonment until he returns to Islam.
