Is the wife entitled to request annulment of the marriage and compel the husband to pay the deferred mahr (dowry) on the grounds of not providing an independent home, and is the judge's approval of this request valid?

It is the wife's right that her husband provide her with independent accommodation with its facilities. She is not obligated to live with his family due to the harm that may result from it. This right is further affirmed if independent accommodation was stipulated, based on the Prophet's (peace be upon him) saying: "Indeed, the conditions most worthy of fulfillment are those by which you make intimacy lawful." If he does not provide it, the wife has the right to seek divorce, and she is entitled to her deferred mahr (dowry). The ruling of the Sharia (definition) court is enforceable.
