Swearing an oath by divorce is impermissible. If the husband swears an oath concerning something he believes to be true, there is no consequence for him. However, if he swears falsely, which is known as a "ghamus oath" (a perjured oath), the majority of scholars hold that the divorce takes effect. In contrast, Sheikh al-Islam Ibn Taymiyyah was of the view that it does not take effect if the intention was to make an oath, and he is not bound by the vows, divorces, or prohibitions he committed himself to. It is advisable to consult the courts.
