Is it permissible to marry another man secretly, given the injustice of the judge and the husband, knowing that the husband has sworn an oath of divorce more than 10 times, and the waiting period ('iddah) has ended?

The issue of a wife claiming divorce and the husband denying it falls under the jurisdiction of the Sharia (definition) court, or Islamic centers in non-Muslim countries. It is not permissible to resort to secular courts for this matter except out of necessity. The divorce or khul' (divorce at the wife's instance) decreed by secular courts is not considered valid, and it is not permissible for the woman to marry another man until a divorce or khul' occurs and the waiting period ('iddah (definition)) ends. It is advisable to withdraw the lawsuit from secular courts and refer it to Islamic centers, and to accept the ruling issued by them. The default assumption is that a Muslim judge is just, unless proven otherwise.
