The question

What is the ruling regarding someone whose mother swore that he would not run a red light, but he ran it 8 times? Is the expiation (kaffarah) due from him or from her? And is it for one time or 8 times, considering that feeding eighty needy people would be difficult?

The answer

It is a Muslim's right upon his brother to fulfill his oath, unless it involves something forbidden. This is particularly emphasized in the case of a mother. Honoring one's mother and obeying her in what is good is an obligation, and it is not permissible to cause her to break her oath or to disobey her by running a red light due to the danger and disobedience involved. The expiation () is incumbent upon the mother who made the oath, and it is permissible to pay it on her behalf with her permission, because it is an act of worship that is not valid without intention. If the swearer breaks his oath once, his oath is dissolved and the expiation becomes binding upon him. He is not required to repeat the expiation by repeatedly breaking the oath, unless he takes another oath or his intention was to repeat the breaking of the oath.
