The answer

Murabaha selling, as practiced by some Islamic banks for individuals, is permissible if it adheres to the Shariah controls, such as the bank genuinely owning the commodity and it entering into its possession and guarantee before selling it to the requesting party. The prior promise in this case is merely a promise and not a contract. The bank taking a down payment (earnest money) to ensure the seriousness of the buyer does not affect this, provided that only the amount of actual damage incurred by the bank due to repudiation is deducted from it. However, the format in which the bank buys the commodity from the inquirer and then sells it back to him is unclear, and perhaps what is meant is organized Tawarruq.
