It is permissible for the ولي الأمر (ruler/guardian) to restrict what is otherwise permissible, if doing so serves a public interest, and obedience to him is obligatory. So, if prohibiting the raising of a building is for a clear public interest, or if violating this prohibition leads to a clear public harm, then it is not permissible to transgress it. However, if that is not the case, then there is no sin in violating it. The assessment of interests and harms should be referred to experts and specialists. And whoever sells a share in a building approved by the responsible authorities, there is no sin upon him in benefiting from its price.
