The question

What are the rights of daughters in the inheritance of their deceased father, given that the father had transferred ownership of assets and real estate to the males during his lifetime, and had designated a property for them (the daughters) without official registration, and the male siblings claim that the daughters' right to this property only materializes after the mother's death?

The answer

Justice among children in giving gifts is a prophetic command, and scholars have differed on whether it is obligatory or recommended. A father's will bequeathing a specific building to his daughter is a bequest to an heir, and it is not enforceable unless the other heirs agree, according to the Prophet's saying, "There is no will for an heir." If the brothers and the mother agree to enforce it, the mother's death is not a condition for its enforcement. It is advisable to consult the court to consider the circumstances of the matter.
