No text has been reported from the Prophet, peace and blessings be upon him, prohibiting the testimony of women in marriage, Hudud (punishments), and divorce. However, what has been reported from Al-Zuhri is that the has established that the testimony of women is not permissible in Hudud, marriage, and divorce. Jurists have differed regarding the testimony of women in matters that men usually have access to, such as marriage and divorce. The majority of scholars have prohibited their testimony in these matters, citing as evidence the verse: "When death approaches one of you, at the time of bequest, [let there be] two just men from among you" (Quran 5:106), and the : "There is no marriage except with a guardian and two just witnesses," and by analogy to Al-Zuhri's statement. Whereas the Hanafis have permitted the testimony of women in everything except Hudud and Qisas (retaliation), based on the generality of the verse.
