What is the ruling on a contract concluded by a man to purchase tree fruits three months before their ripening, which includes determining the purchase price per kilogram, specifying the harvest time with the seller undertaking it, the seller performing agricultural operations until the fruits ripen, and the seller bearing responsibility for fruits that fall before the harvest date, while the buyer is responsible for those that fall after it?

It is not permissible to sell fruits before their ripeness appears, with the condition of leaving them on the tree, according to the consensus of scholars, due to the : "The Prophet, peace and blessings be upon him, forbade the sale of fruits until their ripeness appears." However, selling them after their ripeness appears is permissible absolutely. If the fruits are destroyed by a heavenly affliction, the loss is on the seller. If they are destroyed by a human act, the buyer has the choice between annulling the contract or demanding compensation from the perpetrator.
