Who bears the loss of an apricot crop, sold while still on the trees, which was destroyed by hail after the conditions of the sale were met? Is it the seller or the buyer?

If a farmer sells produce after it has begun to ripen, and then it is afflicted by a heavenly blight before the buyer can take possession of it, then the responsibility for the damaged produce falls on the seller-farmer. This is because it is not permissible for him to take his brother's wealth unjustly, as the Messenger of Allah (peace and blessings be upon him) said: "If you sell produce to your brother and it is afflicted by a calamity, it is not permissible for you to take anything from him. How would you take your brother's wealth unjustly?" Therefore, whatever produce is damaged before the buyer takes possession of it must be deducted from the price.
