It is not permissible to sell fruits before their ripeness appears, with the condition of leaving them on the tree, according to the consensus of scholars, due to the hadith: "The Prophet, peace and blessings be upon him, forbade the sale of fruits until their ripeness appears." However, selling them after their ripeness appears is permissible absolutely. If the fruits are destroyed by a heavenly affliction, the loss is on the seller. If they are destroyed by a human act, the buyer has the choice between annulling the contract or demanding compensation from the perpetrator.
