What is the ruling on my saying to my wife, "I swear by Allah, if you do that again, I will send you to your family's house"?

The statement made by the questioner: "I swear by Allah that if you do that again, I will send you to your parents' house" is an oath contingent upon the wife's action. The phrase "I will send you to your parents' house" is a كناية (allusion) to divorce, which does not take effect unless intended. So, if he intended divorce by it, he must pronounce it or send her to her parents if that was his intention, or do something else that falls within his intention. He also has another option: to break his oath and offer expiation for it, which is more preferable. Anger does not prevent an oath from being binding as long as he is conscious and acting by his own choice, and doubts and whispers should be ignored.
