What is the ruling on a man traveling for Jihad in Syria, while his non-observant foreign wife is attached to him and would be psychologically affected by the idea of his travel, and he fears that harm may befall her because of him?
If a young man marries a young woman with a legal contract, it is not permissible for him to travel and leave her unless he ensures her safety, and he may not be absent from her for more than six months except with her permission. He is also not allowed to cut off communication with her. If he does not desire her, then he should divorce her honorably.
If the young woman has pronounced the Two Testimonies but has not committed to the rituals and insists on this after being taught, then she is an apostate from Islam, and the marriage contract is thereby annulled. However, if her Islam improves before the expiry of the iddah, she may return to him with the original marriage contract.
