It is permissible for a father to marry off his young, pre-pubescent daughter with mutual agreement. However, if she is a thiyb (previously married woman), her marriage is invalid. If she is a virgin and has reached puberty, the preponderant opinion is that the marriage contract is not valid without her permission, because the Prophet, peace and blessings be upon him, said: "A previously married woman should not be married until she is consulted, and a virgin should not be married until her permission is sought." The Prophet, peace and and blessings be upon him, called her a virgin who has reached puberty. Also, because he gave a choice to a young woman whose father had married her off without her permission. If it is established that she gave permission and remained silent if she was a virgin, or explicitly accepted if she was a thiyb, then the marriage is valid. Otherwise, she has the right to refer her case to the Sharia courts to choose whether to uphold the marriage or annul it.
