ما هو نصيب كل وارث من تركة الميت، إن كان ورثته: زوجة واحدة، وأربعة أبناء عم أشقاء، وبنتين لابني عمومة؟
The paternal uncle's daughters are not among the heirs, so they have no share in the inheritance. If a person dies leaving behind his wife and paternal uncle's sons, and no other heirs, then his wife gets one-fourth due to the absence of a direct descendant, as Allah Almighty says: "And for them [i.e., the wives] is one fourth of what you leave if you do not have a child." The remainder goes to his paternal uncle's sons by ta'sib (agnatic inheritance), based on the Prophet's (peace and blessings be upon him) saying: "Give the prescribed shares to those who are entitled to them, and whatever remains is for the closest male relative." Thus, the inheritance is divided into sixteen shares: four for the wife, and three shares for each of his full paternal uncle's sons.
