Epilepsy is one of the marital defects that permit the annulment of the marriage contract. If the husband becomes aware of his wife’s epilepsy after the contract and before consummation, and he annuls the marriage, the wife is not entitled to a mahr (dowry), because the annulment was due to a defect in her. Ibn Qudamah stated that annulment before consummation does not necessitate the mahr, whether the annulment was initiated by the husband or the wife, because an annulment due to a defect in the wife is considered as if the annulment originated from her. As for Ibn Uthaymeen, he stated that the wife is not entitled to a mahr if the defect is in her, because she committed deception. However, he holds that the wife is entitled to half of the mahr if the defect is in the husband and she annuls the marriage before consummation, because in this case, the separation is caused by the husband.
