Generally, a person under interdiction (due to minority, foolishness, or senility) cannot take possession for himself, and a debt is not discharged by paying his right except by its possession by his guardian, or his trustee, or the judge. This is because the authority of the representative in taking possession is established by the legislator, and a person under interdiction is not qualified to take possession of what he is entitled to. Possession is only valid when taken by someone who is legally competent to act, i.e., an adult, sane, and not under interdiction. So, if a child takes possession of what was gifted to him, his possession is invalid and he does not acquire ownership of it. If the creditor tells the debtor: "Deliver my right to this child," and the debtor delivers the amount of his right to the child, he is not discharged from the debt; rather, what he delivered remains his property.
