What should a wife do when her husband, in a fit of anger, has sworn an oath of divorce for the eighth time that she should not go to her mother's house or speak to her on the phone, especially since he always redeems such oaths by paying expiation for the oath, and she does not want to displease her mother?

The majority of scholars hold that swearing by divorce results in divorce upon breaking the oath, and expiation for an oath is not sufficient. However, Sheikh al-Islam Ibn Taymiyyah is of the view that it does not constitute a divorce unless the husband intended to suspend the divorce thereby; otherwise, it requires expiation for an oath. Based on the view of the majority, the woman would be irrevocably divorced (three divorces) and would not be lawful for her husband until she marries another man. As for the husband's oath to prevent his wife from visiting or speaking with her mother, if the reason for it is fear of corruption, then she is not permitted to break his oath. If the reason is otherwise, then she may break his oath and visit her mother. The husband is advised to avoid anger.
