What is the ruling on one who swore by divorce not to speak to a relative of his due to the corruption of his morals and intentions, and has not spoken to him for five or six months?

The Sharia has prohibited discord and abandonment among Muslims, especially among kin. Abandoning a disobedient relative depends on what is beneficial: if abandoning him helps bring him back to rectitude, then that is more appropriate; but if maintaining ties with advice is more beneficial, then that is more appropriate. As for swearing by divorce, the majority view is that divorce occurs if the sworn-upon condition takes place, while Ibn Taymiyyah holds that it is an oath requiring an expiation for an oath if divorce was not intended. If this was the first or second divorce, then one can speak with the relative and then reconcile with the wife. However, if it was the third divorce, then refraining from speaking is less harmful. It must be noted that swearing by divorce is not permissible.
