Is it commendable to waive a right for a driver who made a mistake only if he prays, and will the one who waives his right not be rewarded if the driver abandons prayer?

Blood money is a fixed right for the guardian of the slain unless he willingly waives it. If he does not agree to waive it for the one who abandons prayer, he has the right to do so. However, if he gives it as charity to the one who abandons prayer, there is no sin upon him, and perhaps that would be a reason for his return to his religion and his preservation of his prayers. If the reason for refusal is that the perpetrator abandons prayer, then there is no legal impediment to waiving it for him. While it is recommended to allocate charity to the righteous and people of good, it is permissible to give charity to a transgressor or a disbeliever, based on the generality of Allah's saying: "And they give food, in spite of love for it, to the needy, the orphan, and the captive" (Quran 76:8), and the Prophet's (PBUH) saying: "In every wet liver (living creature), there is a reward."
