Does a man's triple divorce of his wife via email count, when there has been no consummation, but there has been a private seclusion and menstruation?
A wife is not permitted to seek a divorce without a legitimate Shar'i (Islamic legal) excuse. The husband's desire to marry another woman is not considered such an excuse. The questioner was hasty in seeking a divorce and should have consulted people of wisdom. It was not permissible to spy on the husband's mail. Divorce by message takes effect if the husband intended it. The triple divorce uttered in a single phrase and the divorce of a menstruating woman are both valid according to the majority of scholars. Therefore, if the husband intended divorce, the major irrevocable divorce (al-baynunah al-kubra) occurs. Everything that happens in the universe is by Allah's divine decree and destiny.
