Is a wife who left the marital home due to a minor disagreement and went to her family's house, then insisted on divorce without cause, and whose husband subsequently abandoned her due to her insistence—is she considered to be in the ruling of the "suspended" (mu'allaqah), especially if the husband did not marry another wife?

A wife is not permitted to leave her husband's home except with his permission, nor is she allowed to seek divorce without a legitimate Shar'i reason. If she leaves without his permission, she is sinful and disobedient (nashiz). The treatment of nushuz (disobedience) does not begin with abandonment (hajr). Abandonment should be in the conjugal bed. It is permissible to abandon her verbally because she is disobedient. A husband's abandonment of his wife due to her nushuz does not render her "like one left in suspense," rather it is a disciplinary measure. It is advisable to strive for reconciliation and to involve wise individuals. A husband is permitted to marry a second wife if he is capable of providing for her and being just, but he should not use this matter as a threat.
