Is it permissible for a father to withhold his daughter from her husband and prevent him from consummating the marriage due to a slight weakness on the husband's part that has delayed the consummation?
The husband's sexual weakness is not a defect that annuls the marriage, unless it reaches the point of impotence (inability to penetrate). The wife's father's action was rash and not permissible শরী‘আ wise, because the condition had not reached the level of impotence. Even in the case of complete impotence, haste is not permissible; the majority of scholars oblige a one-year postponement for the impotent husband for treatment. If he still cannot consummate the marriage after that, his wife is given the choice to stay or separate. The wife's father must return his daughter to her husband to support him during his treatment period, and the husband must strive for treatment, prayer, and seeking forgiveness.
