Is the wife considered disobedient (nashiz) and sinful, in a religious sense, if she refuses to return to her husband's home after a dispute and remains in her family's home until childbirth, which leads to the husband's absence from the birth and his refusal to see his daughter? And is the husband the one who is sinful in this case? And how can the wife atone for her sin if she is the one who is sinful?

A wife must obey her husband in what is right. Her disobedience to him by not returning home without a valid excuse constitutes 'nushuz' (rebellion) and an act of disobedience to Allah, necessitating repentance and seeking her husband's forgiveness. If the husband's absence from the birth and his lack of communication were due to the wife's 'nushuz,' he is not blameworthy for that, though he ought not to have done so. 'Nushuz' is not resolved by divorce. It is advisable to communicate with the wise individuals from both families for reconciliation, as Allah Almighty says: "And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people. If they both desire reconciliation, Allah will cause agreement between them. Indeed, Allah is ever Knowing and Acquainted." The maintenance of a pregnant rebellious wife does not cease, just as the maintenance of the child is obligatory upon the father and cannot be withheld due to 'nushuz.'
