However, when the marital relationship is ongoing, custody is a right shared by both spouses. The deferred dowry (mu'akhkhar al-sadaq) is a right of the woman and is not forfeited except by her waiving it. The husband must treat his wife with kindness, and a husband severely beating his wife is an act of injustice and aggression for which he incurs sin.
