Does the farmer have the right to demand the agreed-upon quarter of the crop, knowing that he was forced to abandon the crop due to forced displacement?
If what occurred between the landowner and the worker was that the land was given to the worker to cultivate and work on, with the produce to be shared between them, then this is a permissible contract of muzara'ah (sharecropping) according to the Hanbalis and the majority of the early Muslims (Salaf). Sheikh Ibn Uthaymeen preferred the view that this contract is binding. The ruling on muzara'ah is similar to that on musaqat (irrigation contract), and a specific duration must be stipulated in it. It cannot be unilaterally terminated as long as the term is still in effect. If the worker is unable to perform the work due to illness or similar reasons, someone else should be appointed to do the work at his expense, and he will still receive his agreed-upon share.
