Is it permissible to take out an interest-bearing loan from a bank to buy an apartment, given that the husband promised his wife he would do so before marriage but did not fulfill his promise, and the wife fears living without shelter should marital disputes occur?

If the father stipulates that the husband provide a home for the wife in her country, then the husband is bound by this condition, based on the saying of the Messenger of Allah, peace and blessings be upon him: "The conditions most worthy of fulfillment are those by which you make intimate relations lawful." The wife is permitted to annul the marriage if the husband does not fulfill the condition.

It is not permissible to borrow from a usurious bank because usury is one of the gravest sins, and its perpetrator deserves to be cursed. Allah has warned those who engage in usury with war, as He says: "O you who have believed, fear Allah and give up what remains [due to you] of usury, if you should be believers. And if you do not, then be informed of a war [against you] from Allah and His Messenger. But if you repent, you may have your principal – [thus] you do no wrong, nor are you wronged."

The wife is advised to be patient with the husband's situation as long as he is unable, and to ask him to provide temporary accommodation in Egypt until he is able to fulfill the condition. Indeed, in patience and piety lies the good of this world and the Hereafter, as Allah says: "Indeed, he who fears Allah and is patient, then indeed, Allah does not allow to be lost the reward of those who do good."
