If it is established that the debtor has encroached upon the creditor's property, the creditor has the right to demand his property. If he cannot obtain it except by taking it from the debtor's property without his knowledge, then that is permissible within the "issue of overcoming" (mas'alat al-zafar), with its conditions.

However, taking the debtor's money in anticipation of future injustice is not permissible, and the money must be returned immediately, even if by selling what was bought with it. The right must be fulfilled before benefiting from what was bought with usurped money.
