When a husband severely beats his wife, it makes him an abuser and an oppressor, and it is considered ill-treatment that contravenes Allah Almighty's command: "And live with them in kindness." This severe beating is an excuse that permits the wife to leave the house without her husband's permission, so there is no blame upon her or her guardian in that, because it is an aid to a matter permissible by Sharīʿah. The wife has the right to bring her case before a judge. We recommend reconciliation between the spouses, due to Allah Almighty's saying: "And reconciliation is best." If reconciliation occurs, she must return to the marital home.
