What is the ruling of Islamic law concerning a man who divorced his wife three times by saying: "You are divorced, divorced, divorced," prior to consummation and privacy, knowing that the wife is still a virgin after five years of marriage and no intercourse has occurred?
If the husband pronounces the words: "You are divorced by three," then his wife is irrevocably divorced from him with a major divorce (baynunah kubra). He is not permitted to take her back until she marries another man out of genuine desire, and then he divorces her or dies, and her 'iddah (waiting period) ends. This is what is given as a fatwa by us, and it is the opinion of the majority of scholars, contrary to Ibn Taymiyyah, who holds that it counts as a single divorce.
