The question

What is the ruling regarding a husband who said to his wife, "You are divorced by three," and then swore three times an emphatic oath of divorce using the following phrases: "She is divorced by three, an irrevocable divorce with no possibility of return," and "She is divorced by three, an irrevocable divorce with no possibility of return, and even if she marries ten times after me, I will not take her back"?

The answer

Most scholars are of the view that a divorce pronounced three times counts as three divorces, and the wife becomes unlawful for her husband until she marries another man. This is the fatwa we adopt, and it means that the wife has been irrevocably divorced (baynunah kubra). Her husband cannot take her back unless she marries another man out of genuine desire, and then the new husband divorces her after consummating the marriage, or dies, and her 'iddah (waiting period) expires.
