What is the ruling on marrying someone who abandons prayer, and is the marriage contract considered void based on the Hadith: "The covenant between us and them is prayer; whoever abandons it has disbelieved"?

The disbelief of one who abandons prayer is established by authentic hadiths. So, for whoever considers abandoning prayer to be major disbelief (kufr akbar) that expels one from the fold of Islam, as is the view of the majority of the Salaf, the marriage is invalid; due to the impermissibility of a Muslim woman marrying a disbeliever. As for whoever considers it to be a lesser disbelief (kufr duna kufr) and not expelling one from the fold of Islam, as is the view of the majority of jurists, then the marriage contract is valid. One who married a person who abandons prayer must repent and renew the contract, and it is not permissible for a Muslim to marry one who abandons prayer.
