Swearing an oath by divorce carries the ruling of a conditional divorce. If the condition for which the oath was sworn is met, the divorce takes effect according to the majority of jurists. Furthermore, uttering the three divorces in a single phrase results in three divorces, also according to the majority of jurists. The fatwa adopted by us in both matters is the opinion of the majority. We emphasize that swearing an oath by divorce is an innovation (bid'ah) and forbidden. It is also impermissible for a wife to go out for work without her husband's permission, unless this was stipulated before the marriage contract. Both spouses should strive for mutual understanding and be cautious not to use divorce as a means to solve problems.
