The question

What is the ruling on marrying a girl who is older than me and has a previous marriage experience, knowing that I cannot distance myself from her, and I have committed adultery with her, and she suffers from spots on her body as a result of my breaking off the engagement, and my confusion has not gone away despite repeatedly performing Istikhara prayer and Ruqyah?

The answer

In choosing spouses, religion and character are to be considered. It is recommended that the wife be righteous, a virgin, loving, and fertile, but it is permissible to marry a non-virgin. Indeed, the Prophet, peace and blessings be upon him, married Khadijah, may Allah be pleased with her, and she was a non-virgin. Jabir ibn Abdullah, may Allah be pleased with them both, also married a non-virgin. It is permissible for a man to marry a woman who is older than him and a non-virgin, especially if she is righteous in her conduct, religion, and character. As for the woman about whom you mentioned lewdness, we do not advise you to marry her unless she repents. You both must repent to Allah for what occurred between you, for falling into the unlawful, and you must sever your relationship with this woman until you marry her.
