What is the ruling on a father killing the young man who violated his daughter's honor and got her pregnant? What is the ruling on taking the money stipulated from him if he does not marry her? And how should the newborn be dealt with to conceal the scandal?

The young man is not legally obligated to marry the woman with whom he committed adultery, and he is not permitted to do so unless there is sincere repentance, based on the Almighty's saying: "The fornicator does not marry except a fornicatress or a polytheist, and none marries the fornicatress except a fornicator or a polytheist, and that has been made unlawful for the believers."

For the marriage of a pregnant fornicatress, it is stipulated by the Malikis and Hanbalis that she must give birth, based on the Prophet's (peace be upon him) saying: "A pregnant woman should not be approached until she gives birth." Some say that the marriage of a pregnant fornicatress is valid, especially if the fornicator is the one marrying her.

Some scholars, such as Abu Hanifa, permitted the attribution of the child of adultery to his father if the fornicator married the mother before she gave birth. However, the majority of scholars hold the view that the child of adultery is not attributed to his father nor is he ascribed to him, and this is the preponderant opinion.

If a man marries a woman who became pregnant by him through illicit means, the child is attributed to his mother and her family, and the mother's husband becomes his stepfather.

Killing the young man in retaliation is impermissible, and whoever kills him deserves retribution (Qisas). The punishment for an un-married fornicator is a hundred lashes and exile for a year, and for a married fornicator (and fornicatress) it is stoning. The Hadd punishment or Qisas should only be carried out by the ruler or his deputy.
