Scholars differed concerning the ruling on performing Sa'y before Tawaf. The majority held that it is invalid, based on the Prophet's (peace be upon him) saying: "Take your rituals from me." Whereas Ata, Dawud, and a group of Hadith scholars held it to be valid, citing the Hadith: "I performed Sa'y before I performed Tawaf?" He said: "There is no harm." The more preponderant opinion is the first one. Whoever performed Sa'y before Tawaf must return to Mecca and perform the Sa'y. If he is unable to do so, then he is like one who is prevented, and he must sacrifice a sheep. There is no penalty upon him if intercourse occurred out of ignorance.
